The annual License fee is € 0 in recognition of your individual membership at European Severe Storms Laboratory e.V. (Wessling, Germany), or to support you in your work as a voluntary observer for ESSL.
The Displayer is a tool for research and education, not designed for operational weather forecasting duties. ESSL does not endorse its use as an operational tool and warns that outages of certain products and the entire Displayer may occur from time to time. ESSL will on a best effort basis strive for those being as short as possible but does not employ a 24/7 team to fix issues on short notice. As a guideline, a 90–95% uptime of the basic Displayer functionality should be expected.
ESSL is not liable for the accuracy, availability, completeness, or reliability of the Displayer or the data contained therein. and cannot guarantee that the utilization of the Displayer will result in the economic, legal, actual or ideal success as intended by the User. ESSL and its partners cannot be held liable for the accuracy, completeness and reliability of assessments, opinions, forecasts, warnings or equivalent pieces of work referring to the Displayer. ESSL and its partners are not liable for defects of any software or data made available to the User nor for financial loss resulting from any such defect.
All data included in the Displayer remain property of their original creators. The Licensee shall ensure that the Licensee’s use complies with the conditions and terms of use of these original creators, if necessary, by contacting the original creators directly in case of doubt.
Neither the access to the Displayer nor any data obtained through the Displayer shall be shared with any third party unless explicit prior permission has been granted by ESSL in writing. ESSL may be contacted through displayer@essl.org to request such an exceptional permission. If the Licensee passes on the access credentials or any information included in the Displayer to an unauthorized third party, ESSL may charge the Licensee with a penalty up to the highest of the following amounts: € 1000 or the total amount of actual damage.
Any data provided to ESSL, including within this form may be stored in the ESSL internal contact database - a cloud service that uses data encryption. ESSL will use it only for communication on matters related to this agreement, handled confidentially and may only be used by ESSL employees authorized to access this data. The GDPR applies.
The license starts as soon as this form has been signed and ESSL confirms the licensing.
ESSL reserves the right to terminate the license at any moment and for any reason.
The ineffectiveness or impracticality of a particular provision of this Agreement shall not affect the validity of any other provisions.
To this Agreement, Austrian law shall be applicable exclusively.
